Importers and distributors have different roles from manufacturers. Both need to check certain product information and take action when they have reason to believe a product does not conform.
Importer checks
An importer established in the Union places a product bearing a non-EU manufacturer’s name or trademark on the market. It checks that relevant manufacturer obligations, assessment and documentation have been addressed and that CE marking and required information accompany the product.
Distributor checks
A distributor makes a product available without changing its properties. It verifies CE marking and certain manufacturer and importer information, instructions and support-period details.
When concerns arise
If an operator has reason to believe a product is non-compliant, the CRA provides duties around withholding it, informing relevant parties and cooperating with market surveillance authorities. The required action depends on the role and facts.
